Ask a salaried employee in India what happens to their salary when they resign, and most will guess. Ask an HR manager which of the four new Labour Codes applies to their establishment, and many will pause. The law has clear answers. Very few people have the time to read it.

The Advocate

Adv. Yashwant Shailendra Soni completed his LL.B. at Banaras Hindu University and his LL.M. at Mahatma Gandhi Kashi Vidyapeeth. He qualified AIBE-XIX, holds the Certificate of Practice from the Bar Council of India, and has qualified UGC-NET (Law). He practises in court alongside his work at The LexSphere, which keeps his advice tied to how disputes actually unfold.

The Author

Adv. Soni writes as he teaches. He has authored two books. The first is Employment Law Handbook: A Practical Guide for Employees, Employers and HR Professionals, co-authored with Adv. Nandini Trivedi and published by Integrity Education India (ISBN 978-81-69917-90-2). It turns resignation, termination, settlement, contracts and HR compliance into steps a non-lawyer can follow.

The second, Offences Against Women and Child (Section 63 to 99) under Bharatiya Nyaya Sanhita, 2023, on which he is first author, was co-authored with Dr. Bhavana C. Dhoundiyal and others.

His research runs alongside his practice. He has published more than ten research papers, with recent work on topics including AI and privacy, constitutional comparison, trade secrets, algorithmic labour law and environmental personhood. He has also presented at a conference on deepfakes.

Why Labour Law, Why Now

India’s four Labour Codes came into force on 21 November 2025, and the Central Rules followed on 8 May 2026. Wages on separation are now due within two working days, and under the Social Security Central Rules 2026, ESI registration is due from the first day of employment. An employer with ten or more employees must also have a POSH Internal Committee in place. A missing committee can attract a fine up to Rs. 50,000, with higher penalties for repeat offences.

The Method: Read, Date, Reply

Most employment disputes turn on a clause nobody read or a date nobody noted. So the advice starts with the document. Read what was signed. Date every event, because timelines decide most labour matters. Reply in writing, calmly, with facts. The same method protects employers: a clear offer letter, a documented performance record and a rule-based exit process prevent more disputes than a legal notice can resolve later.

Accuracy comes first. Every provision cited in a LexSphere explainer is checked against the current text before publishing. If a fact cannot be verified, it is flagged or left out.
